The procurement directives include provisions on exclusion grounds and the Commission has reviewed these rules and set forth legislative proposals in order to implement these into the new act on public procurement. Inherent in the presentation of the provisions and in the special commentaries there is established a clear link to the relevant directives which provide a formal indication as to which provisions are based upon EEA-law. The review shows that some of the provisions are not directly stemming from the procurement directives but reflect the principles of equal treatment, transparency, and proportionality.
