1.3.2 Overview of the content of the Official Norwegian Report (NOU)

The report is divided into four parts. The introductory part, Part I, consists of a summary (Chapter 1), an overview of the mandate and the work of the Commission (Chapter 2) and the developments in the regulation of public procurement in Norway (Chapter 3), and an examination of public procurement in Norway (Chapter 4). Finally, an overview of the regulations in Denmark and Sweden are given (Chapter 5). In Part II, the Commission accounts for its proposals for the new procurement regulations. This part consists of the following general chapters: The structure of the Regulation (Chapter 6), the relationship between the different parts of the Regulation (Chapter 7) and general remarks to the proposals (Chapter 8). It then moves on to the following topics: The objectives of the regulations (Chapter 9), the basic principles (Chapter 10), other policy considerations in public procurement (Chapter 11), exclusions (Chapter 12) , threshold values (Chapter 13), written documentation of the procedure (Chapter 14), provisions on the contract (Chapter 15), procurement procedures (Chapter 16), selection of economic operators in restricted procedures (Chapter 17), communication and e-procurement (Chapter 18), the procurement documents (Chapter 19), selection criteria and documentation (Chapter 20), contract award criteria (Chapter 21), publication of notices (Chapter 22), time limits (Chapter 23), the tender (Chapter 24), exclusion of economic operators and tenders (Chapter 25), cancelation of the procedure (Chapter 26), particular procurement regimes for health, social and other specific services (Chapter 27) and an alternative proposal for a light regime (Chapter 28). Finally, the Commission comments on certain provisions in the new public procurement directive which are relevant to Part I of the Regulation (Chapter 29). In Part III, the Commission gives an account of public procurement in a larger context (Chapter 30) and the economic and administrative consequences of its proposals (Chapter 31). Finally, the Commission puts forward the necessary proposals for a new Norwegian Act on Public Procurement and a new Regulation on Public Procurement Regulation (Chapter 32) and gives an overview of the proposal (Chapter 33).
